UK Tier 4 Student Visa Solicitors

For the purpose of studying in the UK the vast number of applications are made under this category of the Home Office Points Based System for visas.

A student visa applicant must ensure they have 40 points which is made up of 10 points for funds, and 30 points for a valid Confirmation of Acceptance for Studies (CAS).

Eligibility

Under Student Tier 4 Visa category, students applying for their entry clearance or visa from the Home Office must show that they have a CAS from a licensed sponsor, but they must also meet a number of general requirements and restrictions such as:

  • Age
  • Security clearance
  • Maximum time limits for studying in the UK
  • Specific requirements for postgraduate doctors or dentists on a recognised Foundation programme
  • For those individuals being sponsored by a Government or international Scholarship agency
  • Interview with Entry Clearance Officers

Therefore, if you are 16 years or older and intend on remaining in the UK for a duration longer than 6 months contact us for one of our specialist student Immigration lawyers to consider your case and advice you accordingly.

Dependants

You will be able to bring your dependant to the UK if you are a student on a Tier 4 Visa, as long as you can show that you can support them financially without recourse to public funds.

Extensions

If you have been granted Entry Clearance, leave to remain as a Tier 4 (General) Student; as a Tier 4 (Child) Student; as a Tier 1 (Post Study Work) Migrant you must apply in-time for an extension of your visa if you intend on continuing your studies in the UK.

Your Questions and our answers about UK Tier 4 Student Visa Solicitors

Given your current situation where your university has withdrawn you from your Tier 4 course, and you’re awaiting the outcome, you may wish to contact the Home Office or UK Visas and Immigration (UKVI) to inquire about the status of your visa. Your university are not immigration advisors and as such may not have the correct information. Typically, if an appeal is ongoing, the applicant will have 3C leave enabling you to remain in the country until the outcome of the decision. You may wish to seek guidance from an immigration solicitor who can provide personalised advice based on your circumstances and assist in exploring options for visa extensions or alternative categories. The most-straightforward route may be to obtain a certificate of sponsorship from a company that holds a sponsorship licence. The company would need to apply for a defined CoS which would enable them to sponsor you for a defined period to work for them. We can assist with the sponsorship licence and the skilled worker visa when you have obtained your CoS. Unfortunately, based on the information you have provided, it is unlikely that you would qualify for a Graduate Visa as there has been a gap between finishing your course. The High Potential Route is also unlikely as you studied in the UK and the route is reserved for applicants who have studied at a top-tier university overseas which is restrictive. You should ensure your application is submitted to switch to a Skilled Worker Visa prior to the expiry of your current leave otherwise there may be overstaying factors that may affect your application. Your current visa status will endure until a decision has been reached on your Skilled Worker application even if this is after the expiry. You would need to be allocated a Certificate of Sponsorship (COS) for this to apply. For more information, please call 02039599123 or click here

Thank you for your enquiry. You may be able to apply as a dependent on the basis of your relationship however there are certain eligibility criteria that must be met to prove the relationship is genuine. There are also additional financial requirements that your sponsor would need to adhere to. For more information please call us on 02039 599123 or contact us here.

Your university would need to approve and provide a new CAS as this is one of the requirements under the Student Visa route. When you have received this, you may be eligible for a Post-Study Work Visa on completion of your academic degree.

Unfortunately, if you are in the UK on a Student Visa then this would not count towards continuous residence and you would likely not be able to apply for Citizenship on this basis. Other routes such as Skilled Worker do count towards this. For a full discussion, you can call us on 02039 599123 or contact us here

A student visa does not provide a route to settlement in the UK. You would need to switch to another visa first for this to count towards the continuous residence requirement.
