Successful Case Study
Our client, who entered the UK in 2010 as a student, had valid leave until 2014.
His wife also had leave until August 2014. Their application under Tier 1 Entrepreneur was refused in September 2014. We were instructed to lodge an appeal against this decision.
Our client secured a job and was issued with a Confirmation of Sponsorship (CoS) and instructed us to withdraw the appeal. He received a refusal letter in April 2015 as the CoS was not valid as the sponsor’s licence was revoked. He was given right to administrative review, which we exercised on his behalf. At the same time, the sponsor was challenging the decision to revoke the sponsorship licence.
The Home Office rejected the administrative review saying our client made an invalid application because of the sponsorship licence being revoked. We sent a pre-action protocol letter pointing out the Home Office’s erroneous approach and applied for permission for a Judicial review (JR). The Secretary of State for Home Department acknowledge the JR and provided a consent order, agreeing to conduct an administrative review which we opposed as we wanted the SSHD to consider our client’s sponsor’s licence which has been reinstated. This was taken into account and our client was asked to pay for the application fee again to reinstate the application, which he did.
The Home Office, again, refused the application wrongly, as they applied the wrong codes of practice for the salary requirement. Our client was again given a right of administrative review.
We submitted this review, which was successful. Our client received a Tier 2 visa after two years of applications and litigation.
