Changing Your UK Immigration Solicitor

  • Posted on

A significant proportion of our immigration clients have already instructed one or two other Immigration Solicitors before deciding to change their immigration lawyer and coming to OTS Solicitors. Many say they would have changed solicitor earlier if they had realised they could do so.

In this blog, our Immigration Solicitors explain what you should look for when changing your Immigration Lawyer.

Why change your Immigration Solicitor?

There are many reasons why you may consider changing your immigration lawyers. For example:

  • You have had your visa application refused
  • You don’t think you were given the best immigration legal advice on the visa that was right for your circumstances
  • You think that your Indefinite Leave to Remain application was refused because your Immigration Lawyer did not explain a technical point or failed to tell you what evidence was needed in support of your application
  • The solicitor does not reply to emails or phone calls
  • The process is taking too long
  • You have lost confidence

Whatever the reasons you are contemplating changing your immigration solicitor you need to honestly ask yourself if it is right to consider a change. For example, the lawyer may have told you what evidence was necessary but you thought you could get your visa without going to all the hassle of supplying it. If you think the process is taking too long, consider what timescale information was given to you at the outset of your instructions and what, if anything, has changed since then. You may still decide that you want to change lawyers but an honest look at the reasons for the change will help you with your choice of new immigration solicitor.

Choosing a new Immigration Solicitor

At OTS Solicitors we welcome calls and inquiries from visa and settlement applicants looking to change solicitors.  We understand that whether you are applying for your first Skilled Worker Visa from overseas or are applying in-country for a Spouse Visa extension the success of your visa application is of the utmost importance to you. We therefore totally get why you will want to grill us on our credentials and legal ability to take over your visa or ILR application or appeal. When you are changing immigration solicitors it is natural to be wary and to want to ask questions before committing yourself.

We will need to know a bit about you and why you want to change solicitor to see if we can help you. We will also need to understand if there are any time pressures. For example, if you want to apply for an administrative review or to appeal against the refusal of a Spouse Visa there are time limits to do so. For example, if your sponsor has lost their sponsor licence and your Skilled Worker Visa has been curtailed, you urgently need to submit a new visa application before your Work Visa ends to avoid being classed as an overstayer.

Whatever the reasons behind your wanting to change solicitor we need to be sure that OTS Solicitors can help you and meet your expectations. We never guarantee success with a Home Office application but we do promise exceptional client service and attention to detail. We will give you an honest opinion on your chances of success so you know what you are up against and give you a cost and time estimate.

In many cases, clients transfer their immigration instructions to us from a solicitor who does not specialise in immigration law or in their type of visa application. At OTS Solicitors we are recognised for the quality of our immigration law advice through our inclusion in the 2024 Chambers Guide to the Legal Profession and by winning an award for Immigration Law Firm 2024.

The awards do not give you a clear idea of what it will be like to work with us. We rely on client reviews to do that for us. We find that a relieved immigration client can express themselves far more eloquently and sincerely than we can do so. In the end, after doing all your due diligence and research on your choice of immigration solicitor, it may come down to how you feel when we speak to you. Do you get a sense that you can work with us and that you can trust us to put you first? If you do, then it sounds as if we could be a good fit for you.

When you select us as your new Immigration Solicitors, we will explain what we are going to do for you and explain what you need to do for us.

Working as a team is the key to a successful visa or settlement outcome with the Home Office. While we will provide expert immigration legal advice and apply the law to your circumstances, we need to have full background information from you so we can write a compelling application for you by linking your information to the visa or settlement application criteria and case law. If we are asking the Home Office to exercise discretion in your favour, it is not simply a question of saying that you have human rights or a right to family life. If we are persuading a Home Office official to grant you an Unmarried Partner Visa after two or three previous refusals, we need to go above and beyond in how we accurately set out your case. We also need your support by your providing us with all necessary paperwork, such as your bank statements or evidence of your relationship with your unmarried partner.
