Sponsorship Licence Applications- The New Points Based Immigration Rules

“It is a no brainer that Small or Medium Enterprises (SMEs) that do not have a sponsorship licence should consider applying now if they want to sponsor skilled migrants, which will include people from the European Union, from January 2021.”

A new points-based Immigration system (PBS) will come into effect from 1 January 2021 as announced by the Government in February 2020 and the Home Office has published new guidance in relation to this announcement.

Is this good news for some SMEs?

This announcement was well received by many small or medium companies/organisations looking to expand their businesses in the UK. From 1st January 2021, the job will need to be at a required skill of level 3 or above on the Regulated Qualifications Framework (RQF), or the equivalent level in Wales or Scotland. This is approximately equivalent to A-level standard. Please note at present the required skill level of level 6 or above is needed to offer a job.

Besides this, another important change will be the minimum general salary threshold will be reduced from £30,000 to £25,600 (with lower salaries in certain circumstances, such as new entrants to the labour market). However, it is important to note that the job should be genuine and there will be an obligation on the SMEs to show that there is a genuine vacancy that requires a skilled person that they cannot obtain in the UK.
