The rate of applications sent to the Home Office for EEA Residence Cards and permanent residence cards have significantly increased since the UK voted to leave the EU and thus, this may be the reason for the delay in making decisions on such applications.
Nevertheless, the Home Office is under a duty to issue EEA residence documents within 6 months as stated within paragrapgh 17(3) of the EEA Regulations (as amended). If the Home Office fails to comply with their duties under the EEA Regulations, Applicants may be able to challenge the delay, depending upon individual circumstances.
