I told my Employers in Aug 2020 I was staying away as per Section 44. Between Aug and Nov 2020 they paid me in full. On Nov 11th they asked me to be Furloughed, pay being made up to 100% so I agreed. 24th Dec they wrote to say they had agreement with the Union that from January 1st 2021 pay would no longer be topped up to 100%. I immediately replied saying I did not agree or consent to that and as far as I was concerned as of 24th Dec 2020 I was back on to my normal T&C and still claiming Section 44 because nothing had been done to alleviate my concerns.I had no reply, however when January & Feb pay came it was at the reduced amount. My employer claims between them and the union and collective bargaining agreement then they can force me to be Furlough at the lower rate?
